Cherokee Land Laws: Zoning & Deed Restrictions in Murphy, NC

Many parts of the United States, including Cherokee County, operate under specific land use controls, commonly referred to as Cherokee land laws, which aim to make real estate developments uniform, similar, or prevent problems before they ever occur. We commonly get asked about how Cherokee land laws affect zoning in Murphy, NC.

Zoning

Most of Cherokee County has NO zoning. The only part of the county that does have zoning is the Murphy NC City Limits, which are actually quite small compared to what many people are used to. The City Limits is broken into several different zones like commercial and residential with varying levels of each.

Deed Restrictions

Mostly, Cherokee County is governed by deed restrictions, which are a significant part of Cherokee land laws, dictating what cannot be done on a property. They are said to “run with the land,” meaning they cannot be altered and regardless of who owns it, the restrictions remain intact (unless they expire).

Generally speaking, deed restrictions are very basic in Murphy with the main intention being to retain property values and keep places looking nice. You usually find them in subdivisions and communities. We don’t really have any with super-strict requirements like some horror stories we hear from other places – thank goodness! Many of our common restrictions are:

  • No mobile homes, manufactured homes, and in some cases, modular homes.
  • No junk cars or untagged or unlicensed vehicles.
  • No used appliances to be left on property and all trash to be in refuse containers.
  • Certain square footage limitations. Our common range is from 800-1400 square feet minimum, depending on the community.
  • Many more recent ones reference “Earth Tone” colors to be used on the house so you don’t have a random pink, purple, or yellow house in a cabin community.
  • No livestock/farm animals – sorry! In some cases, your dream of a llama farm is no more! 😉
  • Must complete a home within 1 year of beginning building

That gives you a good idea of many of the common restrictions we see.  Although older, many of our newer restrictions say the same basic thing.

Unrestricted

Under Cherokee land laws, you can do anything you like, so long as it’s legal, with unrestricted real estate. This flexibility is often not available in areas with strict zoning under Cherokee land laws. An unrestricted parcel may be perfect for you if you’d like to: 

  • Have an RV or camper on your land for extended periods of time
  • Build a house over a long time (over a year’s time)
  • Have livestock or other animals
  • Run a commercial business out of the “normal” areas
  • Simply not have to worry about someone else’s rules

Larger tracts of land (3 or more acres) are not very hard to find that are unrestricted. Smaller parcels less than three acres can be more challenging to find depending on the area you want to be.

This Saturday was an absolute blast! More than 600 kids in the Murphy, North Carolina area met in the Martins Creek / Brasstown area to enjoy one major event – the Scott Hogsed Memorial Youth Day.

Every year for the past four or five years, Scott Hogsed Memorial Day has been orchestrated in August by Mr. Sam Hogsed for the sole purpose of educating kids on the outdoor sports. There were groups of classes on everything from fly fishing, rope bridges, bow and arrow shooting, BB gun shooting, and so much more.

To top it off, every kid that comes gets a gift bag full of goodies and a FREE fishing rod! At the end, they even give away more things such as a bow, gun, all sorts of things with the sole purpose to entice children to get outside and enjoy all the thing nature offers here in Murphy NC.

Fall is the time for Food, Fun, Frolicking! And Real Estate!

Fall is in the air!  You can most defiantly tell with the trees starting to turn in the higher elevations, cool crisp mornings and to die for evenings.  I think Fall is my favorite time of the year. Pumpkins, mums, pansies, Halloween, trees and festivals are just a few reason why.  If you check out the mountains in the Fall you will need to bring a light weight coat or sweater.  Jeans or shorts are fine and short sleeves are great during the day.  Temperatures range from 50’s in the morning and low 80’s to mid 70’s during the day.  Make sure you bring some walking shoes or boots because you will most defiantly want to take a walk…it is so beautiful in the Blue Ridge / Smokey Mountains! We love going to all the festivals in the area and surround counties.

Sold Real Estate Market Update for Murphy NC – Homes and Land

This month’s real estate update should be rather enlightening, especially since we are applying new approach to tracking the market. We hope that in addition to traditional statistics, this method will help us identify trends and find “holes” in the markets. To top it off, we’ve been working to have our Bi-Weekly Update published in the Cherokee Scout, Murphy’s leading newspaper. We hope to have this edition published in next week’s paper, so keep an eye out for it!

The real estate market here in Murphy NC has been showing some strong underlying fundamentals while some elements many people consider “important” have declined. Here’s what that means: most people look to prices and volume of real estate to determine how strong a market is. While both are very important elements, others are equally important and never discussed. When the market began to shift, one of the key indicators it was happening were the Days on Market. Days on market for homes has evidently peaked out spiking as high as 309 days this year alone. Those have been trending downward significantly and have entered the 100 day range several times this year – in fact, this past month’s average has been a mere 177 days to sell a home.

Volume has been holding steady with first quarter average sales being 17 sales per month and second quarter bringing 21 per month. During this third quarter, we’re currently at 19 sales per month, so the market is continuing to hold ground on volume. This is a great sign! It indicates we’re leveling off and buyers are continuing to hold faith – and they should!

Price is often one of the most important issues people deal with in the real estate market. Although very important to buyers and sellers alike, it is not a key issue statistically as supply and demand reign supreme and ultimately determines the price of a home. It is of the utmost importance for your property when selling it to pay attention to the laws of supply and demand. It determines the amount of showing activity which in turn can determine contract activity. Generally, you should be averaging between 8-12 showings in a 45-60 day period, and if you’re not, the market is likely indicating your property is overpriced. If you feel your property might be experiencing this issue, please let us know and we will tackle this issue head on to find out what the concern is and correct it.

July’s SOLD Real Estate Market Update Report for Murphy NC

Good afternoon! 2009 is proving to be a beautiful summer. Lake Hiwassee is full; the weather has been great here in Murphy. Its summer and a great one at that!

All that good weather is bringing lots and lots of travelers. Driving down 64/74 (the 4 Lane as we call it), there’s tons of traffic and lots of out-of-state license plates. Tourism is great this year! Our new cabin rental company, Mountain Country Cabin Rentals, is experiencing a very good volume of renters and has several spectacular homes for rent. This is great because it means FOLKS ARE IN MURPHY!

Real estate sales volume has been holding very level this year and continues to do so. In the past two weeks, there have been 13 properties to close and an amazing 26 to go under contract. Almost one a day! If you remember from our Sold Update before July 4th, we’re down 4 closings over the past two weeks. Even down a fuzz, the great thing is that you cannot believe the hear-say. Real estate is selling.

Showings have been amazing. There are a lot of our RE/MAX agents and agents in other real estate offices burning up the roads showing homes and land. Every time I check the volume of showings on our listings, I’m pleasantly surprised at the amount of times homes have been shown. If market confidence will continue to increase, the sheer amount of showings will turn into some serious closings.

With that said, summer is getting close to being over. This year, the first day of Fall is September 22nd. That means the highest volume time of real estate selling is coming close to a close. It is proving to be very important to have your home or land well presented, priced aggressively in the marketplace, and to have exceptional marketing of it in place.

  • 92.61% – The list to sell ratio – in other words, what percentage the house sold for compared to the original listing price
