Location

One of the most well know phrases in real estate is, “location, location, location.” Without a doubt, Tarheel’s location is one of its greatest assets. I tis located behind the Murphy Fire Department in downtown off of Talc Mine Road. Owners are able to enjoy the extremely close proximity to downtown without having to pay any Murphy City taxes.

When you speak with folks who live in Tarheel, you’ll notice that almost everyone mentions how you “feel like you’re in the woods and minutes from town.” Most of the residents can be in downtown Murphy in five minutes or less, depending on what section they are in.

Divisions

Tarheel is divided into several sections:

  • Tarheel North
  • Tarheel West
  • Tarheel South
  • Lover’s Leap

Residents

Tarheel conisists of a great group of folks. It boasts lots of full time residents (including The Poltrock Team! 🙂 With everything from attorneys to teachers to excavators, you get a great mix of folks. There are also a number of part time vacation homes in the mix.

Growth

One my favorite things about Tarheel is the fact that is bordered on one side by Murphy City Limits and by US Forest Service and Lake Hiwassee on the other. This prevents Tarheel from growing into a sprawling subdivision and keeps it what it is today.

Restrictions

Almost every land parcel in Tarheel is restricted preventing things such as mobile homes, random farm animals, junk, and more. Learn more about Deed Restrictions and how they work in Murphy NC. Deed Restrictions and Zoning in Cherokee County and Murphy NC

Many parts of the United States have some sort of land use controls on the real estate to make things uniform, similar, or prevent problems before they ever occur. We commonly get asked, how does zoning work in Murphy NC?

Zoning

Most of Cherokee County has NO zoning. The only part of the county that does have zoning is the Murphy NC City Limits, which are actually quite small compared to what many people are used to. The City Limits is broken into several different zones like commercial and residential with varying levels of each. Deed Restrictions

Mostly, the county is controlled with deed restrictions which govern, usually, things that cannot be done on a property. They are said to “run with the land,” meaning they cannot be altered and regardless of who owns it, the restrictions remain intact (unless they expire).

Generally speaking, deed restrictions are very basic in Murphy with the main intention being to retain property values and keep places looking nice. You usually find them in subdivisions and communities. We don’t really have any with super-strict requirements like some horror stories we hear from other places – thank goodness! Many of our common restrictions are:

  • No mobile homes, manufactured homes, and in some cases, modular homes.
  • No junk cars or untagged or unlicensed vehicles.
  • No used appliances to be left on property and all trash to be in refuse containers.
  • Certain square footage limitations. Our common range is from 800-1400 square feet minimum, depending on the community.
  • Many more recent ones reference “Earth Tone” colors to be used on the house so you don’t have a random pink, purple, or yellow house in a cabin community.
  • No livestock/farm animals – sorry! In some cases, your dream of a llama farm is no more! 😉
  • Must complete a home within 1 year of beginning building

That gives you a good idea of many of the common restrictions we see. In fact, you can download a copy of the Brookgreen restrictions by clicking here. Although older, many of our newer restrictions say the same basic thing.

Unrestricted

You can do anything you like, so long as its legal, with unrestricted real estate. An unrestricted parcel may be perfect for you if you’d like to: 

  • Have an RV or camper on your land for extended periods of time
  • Build a house over a long time (over a year’s time)
  • Have livestock or other animals
  • Run a commercial business out of the “normal” areas
  • Simply not have to worry about someone else’s rules

Larger tracts of land (3 or more acres) are not very hard to find that are unrestricted. Smaller parcels less than three acres can be more challenging to find depending on the area you want to be.

Five Forks Development in Martin’s Creek Community of Murphy, North Carolina

Five Forks is a gated subdevelopment in the Martin’s Creek community nestled in the mountains of Murphy, North Carolina. It is largely respected as one of the finer and better done cabin and chalet developments in Cherokee County. It is complete with a gated entrance that closes at dusk, paved roads, underground utilities, community water system, and spectacular long range views. In fact, you can overlook the mountains of North Carolina and Georgia and even see Lake Nottley in the distance. See the picture below to get an idea of what it’s like on the top of the mountain – and the picture doesn’t even do it justice. Five Forks has a great location and is very close to Bellview. The raw land tract that would become Five forks, or just 5 Forks as a few folks write it, was originally owned by developer Manny Hernandez. The site plan and much of the orchestration was done by our very own RE/MAX mountain Properties Broker/Owner, David Ritz. It wasn’t acquired as one single tract. Rather, Phase 1 was done and then additional parcels were purchased and added to the development over time.

The paved roads are a huge asset. With double lane, paved roads coming into Five Forks, it makes travel a breeze. Much of the other developments in the area lack wide roads and can cause issues when two vehicles approach at the same time. Jonathan Wells (of Wells Contracting) built the initial phase of roads, Chris Dockery, and Bill Cook are the men largely responsible for putting in the road system. As you come in the entrance, you cross a large tract of land and a good thing for the community is that Five Forks owns the road coming in – it doesn’t just have an easement like many do.

It contains 129 lots  ranging from less than an acre to over five acres.

For those who enjoy the outdoors, Five Forks is laced with walking trails and a road system that is perfect for getting out and taking a stroll by yourself, with friends, family, or pets. It even has an outdoor picnic facility complete with a restroom.

Five Forks is well known as a chalet and cabin type community. All of the homes there have earth tone colors and are designed to make you feel like you’re “in the woods” while not secluded and by yourself. Homes in Five Forks start in the 100’s and go to the highest real estate transaction on record at $449,000 (as of this writing).

Interesting Facts on Five Forks

  • Five Forks has a tract 11.63+/- acre tract right in the middle of it that’s not part of Five Forks. It cannot be accessed through the Five Forks entrance, but rather must use Grape Thicket Road and come in through a side entrance.
  • The lots on the Northwestern side of Five Forks (which used to be part of tracts that were part of Grape Thicket) have a secondary right-of-way to come in through Grape Thicket Road. Although this is not as desireable an entrance, it is useable. The large parcel in the middle of Five Forks only has right-of-way through Grape Thicket and cannot use Five Forks’ main entrance.
  • The success of Five Forks is largely contributed to impeccable market timing, great paved roads, competetive pricing, good design, and huge, long range mountain views. Original prices started out around $25,000 and up.
  • Many of the homes built in Five Forks were built by Chris Twiggs, Mark Thorsen, John Ritz, and Ray Newcomb.
